Acceptance of Terms
For Teachers (users of the mobile app Firsteps): By creating an account or interacting with the FirstSteps App, you agree to be bound by these Terms of Use. If you do not agree, you may not use the service.
Description of Service
FirstSteps App is A tool designed for educational environments. It allows Teachers to capture images of students, automatically blur the faces of non-recipient children on the local device, and deliver the final image to the specific Parent via the WhatsApp Business API.
User Categories and Responsibilities
Teachers: You must be an authorized staff member of an educational institution. You are responsible for ensuring you have the necessary internal permissions to photograph students.
Parents: By interacting with our business through WhatsApp and providing consent, you agree to receive images of your child through the same channel. You understand that these images are delivered via WhatsApp, a third-party service owned by Meta.
The "Human-in-the-Loop" Requirement (Blurring Accuracy)
The face-blurring technology used in the App is automated and runs locally on the Teacher’s device.
Teacher’s Duty: The Teacher must review every photo after the automated blurring process and before hitting "send."
No Guarantee of Perfection: We do not guarantee 100% accuracy of the automated blurring algorithm. The final responsibility for ensuring that the privacy of other students is protected rests with the Teacher who initiates the transmission.
Acceptable Use
You agree not to use the App to:
  • Upload or transmit any content that is illegal, harmful, or violates the privacy of any individual beyond the scope of sharing within the educational environment.
  • Attempt to bypass or reverse-engineer the on-device blurring technology.
  • Use the WhatsApp API connection to send unsolicited messages (spam) to parents.
Limitation of Liability
To the maximum extent permitted by Spanish law:
  • The service is provided on an "as-is" and "as-available" basis.
  • We shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the service, including but not limited to the accidental disclosure of a student's likeness due to Teacher oversight or technical failure.
  • We are not responsible for the security or data practices of WhatsApp/Meta, Apple, or Google.
Data Storage and Deletion
Users acknowledge the "Transient Model" of this service:
  • No Online Gallery: We do not store a history of photos. Once a photo is sent, it cannot be retrieved from our servers. Do not remove the original copy if you want to keep the image (for both Teachers and Parents)
  • No Backups: It is the Parent's responsibility to save the photo from within their own WhatsApp chat if they wish to keep the images.
Termination
We reserve the right to suspend or terminate Teacher accounts that violate these terms or misuse the service. Parents may terminate their participation at any time by following the "opt-out" instructions provided in the WhatsApp chat.
Modifications
We may update these terms to reflect changes in technology or law. Continued use of the app after an update constitutes acceptance of the new terms. You will be informed via standard channels of any new updates.
